General Terms and Conditions

This is a courtesy translation. The German version of this document is the legally binding one.

Last updated: June 2026

§ 1 Scope

(1) These General Terms and Conditions (GTC) apply to all contracts for the provision of the software "3D Extruder Control" and associated services between Dennis Wohlert, Lohhof 7, 20535 Hamburg, Germany (hereinafter the "Provider") and the customer.
(2) Deviating terms of the customer do not become part of the contract unless the Provider expressly agrees to their validity in writing.

§ 2 Subject of the contract

(1) The Provider makes the software "3D Extruder Control" available to the customer for managing and controlling 3D printing production, with the feature set described in the selected plan (Free / Basic / Pro / Business).
(2) The software is provided as a locally installable desktop application. The specific scope of services results from the product description on the website at the time the contract is concluded.

§ 3 Conclusion of contract

(1) The presentation of the plans on the website does not constitute a binding offer, but an invitation to submit an offer.
(2) By completing the ordering process [add a description of the specific purchase flow] the customer submits a binding offer. The contract is concluded upon confirmation or provision of the license key by the Provider.

§ 4 Prices and payment

(1) The prices stated on the website at the time of the order apply. All prices are [incl./plus] statutory VAT.
(2) Billing takes place [monthly / yearly] in advance.
(3) Accepted payment methods: [add payment methods].

§ 5 Term and termination

(1) The contract runs for an indefinite period and may be terminated by either party with notice of [e.g. "effective at the end of the respective billing period"] .
(2) The right to extraordinary termination for good cause remains unaffected.
(3) Termination requires text form (e.g. email).

§ 6 Usage rights / license

(1) The Provider grants the customer, for the term of the contract, a simple, non-transferable right to use the software to the agreed extent.
(2) One licence covers one installation. On activation the licence key is tied to exactly one device — in every plan. Each further installation requires a further licence. Changing devices is possible at any time and free of charge: release the previous device in your account, after which the key can be activated on another computer.
(3) The foregoing does not affect multi-workstation operation: if one installation runs as a server on the network, further workstations connect to it without being activated themselves. The number of user accounts follows from the plan.
(4) The customer is not entitled to reproduce the software (beyond its intended use), to rent it out, to sub-licence it or to pass the licence key on to third parties.
(5) Activation. Use of the software requires a one-time activation over the internet; this requires a user account with the Provider. On the Free plan the account is sufficient and no licence key is needed; on the other plans the licence key is added. On the Free plan, too, exactly one device is activated at a time; changing devices works as described in paragraph 2. After activation the software runs locally; no internet connection is required for ongoing operation. Activation without an internet connection is not provided for.

§ 7 Availability and updates

The software runs locally; its functioning does not depend on a permanent server connection to the Provider. The Provider supplies updates as part of the plan, but does not owe any particular availability of external third-party services (e.g. printer cloud, AI providers, shop systems).

§ 7a Pre-release versions (beta/test builds)

(1) Pre-release versions provided during the test phase are not finished and are provided free of charge for testing and evaluation purposes only. A pre-release version carries the version-number suffix -beta .
(2) Pre-release versions may exhibit errors, outages and unpredictable behaviour ; data may be stored incorrectly, altered or lost. The provider gives no assurance as to freedom from errors, availability, particular features or fitness for a particular purpose. Statements about the functional scope of a pre-release version are neither an agreement on quality nor a guarantee.
(3) The customer is obliged to create their own backups regularly and to check the results of the software — in particular invoices, amounts and stock levels — before using them. Tax and commercial-law obligations (in particular the German GoBD rules) remain with the customer.
(4) Features may be changed, restricted or removed at any time; there is no entitlement to their inclusion in the final release. The provider may end the test phase or withdraw a pre-release version at any time.
(5) The liability provisions of § 8 apply, as does the “Preliminary note on pre-release versions” of the end-user licence agreement. Where a version is provided free of charge, the statutory limitations of liability and of warranty rights apply in addition. Mandatory consumer rights remain unaffected.

§ 8 Warranty and liability

(1) The statutory warranty rules apply.
(2) The Provider is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body or health. In cases of simple negligence, the Provider is only liable for the breach of an essential contractual obligation (cardinal obligation), limited to the foreseeable damage typical for the contract.
(3) The customer is responsible for regular data backups.
(4) The software allows manual control of connected 3D printers (e.g. motion, temperatures, filament changes). The software limits control commands to the manufacturer's specified limits for the respective printer model and logs them locally; the protective functions of the printer firmware remain unaffected. The customer must operate the printer only under supervision and in accordance with the manufacturer's instructions. To the extent permitted by law, the Provider is not liable for damage caused by improper operation, modifications to the device, or disregard of manufacturer specifications.

§ 9 Right of withdrawal

Consumers have a statutory right of withdrawal. The details can be found in the withdrawal policy.

§ 10 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the customer's country of residence remain unaffected.
(2) Should any provision of these GTC be invalid, the validity of the remaining provisions remains unaffected.
